Please read these Terms and Conditions carefully before placing an order or using any Sub-Zero Dry Ice service. By ordering, you agree to be bound by the terms below.
1. Acceptance of Terms
By placing an order, requesting a quote, scheduling a delivery or pickup, or otherwise engaging with Sub-Zero Dry Ice, LLC (“Sub-Zero Dry Ice,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions in full. If you are acting on behalf of a company, you represent that you have authority to bind that entity to these Terms.
2. Products and Services
- Dry ice (solid CO₂) — pellets and blocks, food-grade and industrial-grade
- Regular ice — cubed, crushed, and block formats
- Coolers and gel packs — for cold-chain packaging and perishable shipping
- Dry ice blasting / cleaning services — industrial surface cleaning in Florida
Geographic coverage: delivery and pickup across Miami-Dade, Broward, and Palm Beach counties, plus additional Florida locations; export orders to Puerto Rico and the Dominican Republic for qualifying commercial accounts (contact us for rates and lead times).
3. Orders and Payment
3.1 Order Placement
Orders may be placed by phone, email, or through the contact form. All orders are subject to product availability. Sub-Zero Dry Ice reserves the right to decline or limit any order without obligation.
3.2 Minimum Orders
Minimum order quantities and dollar amounts may apply depending on product type, form factor, and delivery zone. Minimums are communicated at the time of quoting and confirmed in your order confirmation.
3.3 Pricing and Quotes
All prices are quoted and invoiced in U.S. Dollars (USD) and are subject to change without prior notice due to CO₂ market conditions, fuel surcharges, or supply fluctuations. The price stated in a written quote or order confirmation is binding for that specific transaction only. Verbal quotes are estimates and are not binding until confirmed in writing.
3.4 Payment Terms

Overdue B2B balances accrue a late fee of 1.5% per month (18% APR) from the invoice due date. Accepted payment methods: credit card, debit card, ACH bank transfer, business check (must clear before product is released), and approved credit accounts.
3.5 Sales Tax
Florida state and applicable local sales taxes will be added where required by law. Customers claiming tax-exempt status must provide a valid Florida Department of Revenue exemption certificate before the invoice is issued. Retroactive tax adjustments will not be made.
4. Delivery
4.1 Service Area
Standard delivery covers Miami-Dade, Broward, and Palm Beach counties, with additional Florida locations serving Orlando, Tampa, and Fort Myers. Deliveries to Puerto Rico and the Dominican Republic are available for qualifying commercial orders arranged in advance.
4.2 Delivery Windows and Lead Times
Estimated delivery windows are provided at order confirmation. One-hour delivery is available for qualifying orders within our core Miami-Dade service area, subject to real-time driver availability and order volume. We make every effort to meet committed windows but are not liable for delays caused by traffic, accidents, severe weather, or other circumstances beyond our reasonable control.
4.3 Receipt of Delivery
An authorized adult (18 or older) must be present to receive the delivery. If delivery cannot be completed because no authorized recipient is available at the agreed time, a re-delivery fee will apply. Sub-Zero Dry Ice is not responsible for sublimation loss resulting from a failed delivery attempt.
4.4 Delivery Conditions — Dry Ice
Dry ice is classified as a Hazardous Material (UN 1845, Class 9) under U.S. DOT regulations. All deliveries include DOT-compliant packaging and labeling. The Customer assumes full regulatory and safety responsibility for the product from the point of receipt onward (see Section 7).
5. Pickup / Will Call
Customers may collect orders at the facility address in the order confirmation, within the agreed pickup window. Sub-Zero Dry Ice is not responsible for sublimation loss resulting from delays in pickup beyond the agreed time.
Vehicle requirements: Customers must arrive with an insulated container adequate for the quantity ordered, and vehicles must be ventilated for dry ice transport (see Section 7.5). Sub-Zero Dry Ice reserves the right to refuse a pickup for safety reasons if the Customer arrives without appropriate storage. Refused pickups due to inadequate containers do not entitle the Customer to a refund.
6. Cancellations and Returns
6.1 Cancellations
Orders may be cancelled free of charge up to 2 hours before the scheduled delivery or pickup time, by phone during business hours. Cancellations received less than 2 hours before fulfillment may incur a fee of up to 25% of the order value to cover preparation and logistics costs already incurred.
6.2 Returns — All Sales Final
Due to the perishable and hazardous nature of ice products, all sales are final. We do not accept returns once products have left our facility or been delivered.
Exception — non-conforming orders: if you receive a product that materially differs from your confirmed order, notify Sub-Zero Dry Ice within 1 hour of delivery or pickup. Sub-Zero Dry Ice will, at its sole discretion, issue a credit, arrange a replacement, or provide a partial refund for the non-conforming portion.
6.3 Equipment and Containers
Any container, cooler, or equipment provided on loan or rental must be returned clean and undamaged within the agreed period. Damage, contamination, or non-return will be charged at the replacement cost of the item.
7. Safe Handling of Dry Ice — Customer Obligations
7.1 Cryogenic Burn Hazard
Dry ice sublimates at −78.5 °C (−109.3 °F). Direct contact with bare skin causes severe frostbite and cryogenic burns in seconds. Always handle with insulated gloves, tongs, or appropriate PPE; never allow children to handle dry ice unsupervised; keep it away from bare skin at all times.
7.2 CO₂ Asphyxiation Hazard
Dry ice continuously releases carbon dioxide gas as it sublimates. Accumulation in enclosed or poorly ventilated spaces can cause dizziness, rapid loss of consciousness, asphyxiation, and death. Never store or transport dry ice in a sealed, airtight container. Never place dry ice in the passenger compartment of a vehicle without adequate cross-ventilation. Always store in ventilated areas.
7.3 Storage Requirements
Store dry ice in an insulated styrofoam or hard-sided cooler — never in a conventional freezer (risk of shutdown or pressure damage). Do not store in a completely sealed vessel (CO₂ pressure buildup can rupture it). Do not place directly on cold-sensitive surfaces without intermediate insulation.
7.4 Disposal
Allow unused dry ice to sublimate naturally in a well-ventilated outdoor area away from people and animals. Do not dispose of dry ice in a sink, toilet, drain, or trash receptacle, and never in a sealed garbage bag.
7.5 Transportation Regulations
- Ground transport (DOT): for quantities over 440 lbs (200 kg) in a single package, additional DOT labeling applies. Sub-Zero Dry Ice provides compliant labeling up to the point of delivery; the Customer is responsible for all DOT compliance from receipt onward.
- Air transport (IATA): dry ice shipped by air is subject to IATA Packing Instruction 954 and Dangerous Goods declaration requirements. Cargo customers and airport operators are responsible for IATA compliance for any onward air movement.
7.6 Customer Indemnification for Mishandling
The Customer assumes full responsibility for the safe handling, storage, use, and disposal of dry ice and all related products from the moment of receipt, and agrees to train all personnel who handle dry ice in the safety requirements above and any additional requirements imposed by applicable law or industry standards.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FLORIDA LAW:
8.1 Liability Cap. Sub-Zero Dry Ice’s total cumulative liability for any and all claims arising out of or related to a specific order, delivery, or service transaction shall not exceed the total amount paid by the Customer for that specific transaction.
8.2 Exclusion of Consequential Damages. In no event shall Sub-Zero Dry Ice be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue or profit; spoilage of perishable goods or products in transit; business interruption or lost contracts; personal injury or property damage resulting from improper handling, storage, or use contrary to Section 7; or data loss or reputational harm.
8.3 Force Majeure. Sub-Zero Dry Ice shall not be liable for any failure or delay caused by circumstances beyond its reasonable control, including acts of God, hurricanes, flooding, tropical storms, supply chain disruptions, CO₂ shortages, labor disputes, carrier failures, or government orders.
8.4 Customer Indemnification. The Customer agrees to indemnify, defend, and hold harmless Sub-Zero Dry Ice, its owners, officers, employees, drivers, and agents from any claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising from the Customer’s misuse or improper handling; failure to comply with applicable safety regulations; third-party claims resulting from redistribution or use of Sub-Zero Dry Ice products; or inaccurate information provided in connection with an order.
9. Intellectual Property
All content published on our website — including text, graphics, logos, photography, product descriptions, and trade dress — is the exclusive property of Sub-Zero Dry Ice, LLC and is protected by U.S. copyright law. No content may be reproduced, redistributed, or used for commercial purposes without our prior written consent.
10. Privacy Policy
Your use of our website and services is also subject to our Privacy Policy, which is incorporated into these Terms by reference. By placing an order, you consent to the collection, storage, and use of your information as described there.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law provisions.
- Good-faith negotiation: the parties will first attempt to resolve any dispute through direct negotiation for 30 calendar days after written notice.
- Binding arbitration: unresolved disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules before a single arbitrator.
- Small claims exception: either party may bring an individual qualifying claim in small claims court in Miami-Dade County.
- Class action waiver: claims must be brought on an individual basis. Arbitration is the exclusive remedy for qualifying disputes.
12. Modifications to These Terms
Sub-Zero Dry Ice reserves the right to modify these Terms at any time. Revised Terms take effect immediately upon posting, with the “Last Updated” date reflecting the most recent revision. Your continued use of our products or services after any revision constitutes acceptance. For active B2B accounts, material changes will be communicated by email with 15 days’ advance notice.
13. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
